Industrial Stormwater Advisory Committee

Extension of Issuance of New 1200-Z, 1200-ZN and 1200 COLS Permits

To adequately respond to comments received on the proposed permits, DEQ is extending the issuance date of the new Industrial Stormwater Permits to Oct. 1, 2011.

The current permit requirements remain in effect for existing facilities operating under the 1200-COLS permit (which affects facilities in Portland's Columbia Slough Watershed and expired on Aug. 31, 2011) and the 1200-Z permit (which affects facilities throughout Oregon and expires June 30, 2012). There will be a transition period for meeting the new requirements. The new requirements will not be effective until DEQ has renewed the existing facilities’ coverage under the new permits. After Oct. 1, 2011 these facilities will receive written notification of the new permit requirements, and the timeline and process for renewing their coverage under the new permits.

Public Notice of Changes to 1200-Z and 1200-COLS Permits

DEQ is proposing changes to two of its industrial stormwater permits: the 1200-COLS permit (which affects facilities in Portland's Columbia Slough Watershed and expires Aug. 31, 2011) and the 1200-Z permit (which affects facilities throughout Oregon and expires June 30, 2012).

    DEQ is proposing additional changes to the 1200-Z and 1200-COLS Industrial Stormwater General Permits. These changes will expedite the renewal of facilities under the new permits and require a 30-day public notice and comment period on a facility’s plan only if the facility exceeded the benchmarks in the current permit based on the fourth year benchmark evaluation.

    DEQ is inviting the public to comment on these specific changes to the permits. The public comment period is July 13 through August 12.

Prior Notice of Changes to the 1200-Z and 1200-COLS Permits - May, 2011

DEQ is inviting the public to comment on the proposed permits. The public comment period is May 10 through June 16, 2011. DEQ will hold public hearings throughout the state in June. For more information, please see click on link to view the Public Notice.

Stormwater Advisory Committee

DEQ convened an advisory committee to provide input to DEQ on proposed changes to the permits. The committee met regularly from June 2009 to April 2011.

Background

In 2007 and 2008, two environmental advocacy groups, Northwest Environmental Defense Center and Columbia Riverkeeper, challenged the 1200-Z and 1200-COLS permits validity under the Federal Clean Water Act. DEQ settled the legal challenge and as part of the settlement agreement, agreed to revise the permits.

In May 2010, DEQ and the environmental advocacy groups amended the settlement agreement to provide additional time for DEQ to develop water quality based benchmarks for copper, lead, and zinc.

DEQ intends to revise these permits by the Fall 2011. The public will have an opportunity to comment on the proposed changes to the permits before they become effective. While these new permits are in development, the requirements under the existing permits remain in effect.
