Rulemaking: Water Quality Certification Procedures for Klamath River Restoration Project

The Oregon Department of Environmental Quality is proposing a rule stating the policy and procedures DEQ would use to evaluate whether the removal of J.C. Boyle dam on the Klamath river would comply with the Clean Water Act, should a water quality certification for the project be requested. A water quality certification may be requested if the Secretary of Interior or another entity determines the dam should be removed and a federal license or permit is required.

DEQ is recommending adoption of this rule by the Environmental Quality Commission at their meeting on Apr. 26, 2012 in Newport, Oregon, and will provide a briefing on the rule at the meeting on Apr. 25. For more information, see the following:

Public Involvement

DEQ worked with an advisory committee during the development of this proposed rule. Information on the advisory committee is contained in the issue paper and on the advisory committee web page. DEQ accepted public comment from Nov. 1 through Dec. 15, 2011 and held a public hearing on Tuesday, Dec. 6, 2011 at the Oregon Institute of Technology in Klamath Falls, Oregon.
