Rulemaking

DEQ administers the Clean Water State Revolving Fund loan program under Oregon Administrative Rules Chapter 340, Division 54. DEQ must also meet requirements under Oregon Revised Statutes and the federal Clean Water Act and ensure program administrative rules address these requirements.

Current rulemaking

The CWSRF Advisory Committee provided recommendations to DEQ to address how the program would allow longer-term financing as another option to a 20-year loan. DEQ developed a rulemaking proposal based on the recommendations and the public will have the opportunity to comment on the proposal prior to its presentation to the Environmental Quality Commission in early 2014. 

Rulemaking Proposal - DEQ is accepting public comments on the rule proposal through 5 p.m. Monday, Dec. 2, 2013. The full rule proposal and information about public hearings on the rule are available to the public via DEQ’s rulemaking website.

DEQ updated and amended the CWSRF loan program’s administrative rules in 2012. The Oregon Environmental Quality Commission adopted the amended rules that are now effective.

Recommendations on the Clean Water State Revolving Fund rule amendments

DEQ amended CWSRF loan program administrative rules in 2009 and 2010 to address federal requirements under the 2009 American Recovery and Reinvestment Act and the 2010 Appropriation Act. These rulemakings ensured timely and effective implementation of federal requirements.
