Title V Operating Permit CPI Fee Increase

In 2009, the Environmental Quality Commission adopted rule amendments that increased Title V fees by 4.6%. The increase was based on the change in the consumer price index, as authorized by state law. EQC adopted the amendments through a temporary rulemaking. The rulemaking documents are listed below. DEQ was unable to perform a regular rulemaking in time for billing in 2009 because the statute that authorizes the fees (ORS 468A.315) required a technical correction. DEQ will perform a follow-up regular rulemaking in 2010. There will be an opportunity to comment during the public participation period of the rulemaking.
