Residential Woodstoves and Other Solid Wood Burning Devices Rulemaking

DEQ finalized rules to implement the program requiring the removal of any uncertified stoves upon home sale, along with other requirements related to solid fuel burning devices. Senate Bill 102, a measure passed by the 2009 Oregon Legislature requires homeowners to remove, destroy, and notify DEQ of any uncertified stove at the time of home sale.

These final rules include:

  • Uncertified stove removal upon home sale - new notification and destruction requirements
  • New certification requirements for residential heating devices. Uncertified stoves, including EPA-exempt stoves and outdoor wood boilers are no longer allowed to be sold in Oregon unless they are certified.
    • Pellet stoves, fireplaces, and masonry heaters are exempt from these requirements.

DEQ presented rules to the Environmental Quality Commission, which were adopted at the February 17-18, 2011 meeting.

Background

Senate Bill 102
The 2009 Legislative bill protects public health and air quality from wood smoke produced by older, polluting uncertified woodstoves. The bill creates new provisions related to woodstoves, such as authorizing the DEQ to implement a program that requires the removal, destruction and notification of any uncertified stove at time of home sale.

As directed by Oregon's Legislature, DEQ developed a proposed "heat smart" woodstove rule that was adopted by the EQC in February 2011.

In developing the rule, DEQ worked closely with an advisory committee of stakeholders to discuss implementation and fiscal components of the program.
