The commission will hold an informal town hall meeting at the Phoenix Inn in downtown Bend. Local government representatives and other guests are invited to attend from 6 to 7 p.m. for informal conversation with the commissioners, and the town hall discussion will convene at approximately 7 p.m. The session is informal, not a part of the regular commission meeting, will not be recorded and is not an opportunity for formal public comment. Light refreshments will be provided for attendees.

A. Action item: Minutes from the Aug. 23-24, 2012, EQC meeting

Commissioners will review and take action on the draft minutes from the Aug. 23-24, 2012, EQC meeting.

B. Action item: Resolution for a permit modification to allow the Umatilla Chemical Agent Disposal Facility to ship wastes off-site for treatment and disposal

DEQ staff will present a resolution for commission action. If adopted, the resolution would allow DEQ to approve a permit modification request related to the final disposal of certain wastes created during the closure of the Umatilla Chemical Agent Disposal Facility.

C. Informational item: Umatilla facility update

DEQ staff will present an update about treatment, disposal and closure activities at the Umatilla facility.

D. Informational item: Regional Solutions Teams

DEQ staff will present information about the members, roles and functions of Oregon’s Regional Solutions Teams and Regional Solutions Centers. DEQ has six staff people assigned to the six centers, located at college and university campuses across the state.

E. Informational item: Tillamook Basin restoration and improvement projects

DEQ staff will present information about innovative restoration and environmental protection activities in the Tillamook Basin.

F. Action item: Water Quality 401 Certification fee rules

DEQ staff will present proposed fee revisions for the Water Quality 401 Certifications program. The proposed revisions would modify the fees DEQ charges for this program and remove fee exemptions for a sector subject to the program’s requirements.

Lunch and executive session
Commissioners and senior DEQ staff will meet with Oregon Department of Justice staff over a working lunch in an executive session from approximately 12:30 to 2 p.m. The session will be held pursuant to ORS 192.660(2) (h).

G. Action item: Water Quality Division proposed permit fee increases

DEQ staff will present proposed fee revisions for most Water Quality Division permits. The proposed fee increase, of 2.7 percent, for most Water Quality Division permit fees, is based on statute allowing annual increases of up to three percent.

H. Action item: Petition to the commission

The commission will take action on a petition submitted by Northwest Environmental Advocates requesting that the commission direct DEQ to conduct rulemaking and take other actions related to pesticides.

I. Informational item: Director’s dialogue

Director Pedersen will present written and verbal updates on agency, state and federal program activities of interest and relevancy to DEQ and the commission.

The commission will recess at approximately 4:30 p.m. Commissioners and some DEQ staff may attend an informal, optional and self-pay dinner in downtown Bend on Thursday evening. No commission business will be held during dinner. Public meeting law requires notice of this dinner.

J. Public forum

At 9 a.m., the commission will open public forum. This item is scheduled for 60 minutes, but time allotted may be extended or shortened at the commission’s discretion. People may present comment in-person or remotely by teleconference call at one of several DEQ offices across the state. No comments may be presented on DEQ rulemakings for which the public comment period has closed. All people wishing to comment must complete request-to-speak forms and the commission may limit times based on the number of people wishing to comment.

Change to: People wishing to present comment by telephone may do so at the Medford, Pendleton or Portland (headquarters) offices.

K. Informational item: Commissioner reports

Commissioners will present verbal updates on their activities of interest and relevancy to DEQ and the commission.

L. Informational and discussion item: Commission annual self-evaluation

DEQ staff will present the results of the commission’s annual self-evaluation. The commissioners’ survey information is entered as DEQ’s Key Performance Measure 16 and helps DEQ and the commission plan for improvements in content and format of materials, information and meeting logistics.
